Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network website and social media guidelines.

To help us maintain the kind of atmosphere where everyone feels welcome to contribute, we’ve developed some community guidelines to ensure all of our community members are allowed a safe, fun and supportive experience.

WOM Insights Pty Ltd (“WOM Insights” or “we”) is the publisher of Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network websites and social pages. We encourage open discussion on these websites and social media pages. However, as a user of these websites and social media pages you promise to abide by the following guidelines.

We expect all members will treat each other with respect. The following types of comments will not be tolerated, and you agree not to post the same:

• Abusive, defamatory, pornographic, or obscene posts, including material that vilifies, incites violence or hatred, or is likely to offend, insult or humiliate others based on race, religion, ethnicity, gender, age, sexual orientation or any physical or mental disability;
• Fraudulent, deceptive or misleading posts;
• Posts that are in violation of any intellectual property rights;
• Posts that are in violation of any law or regulation;
• Posts that are otherwise inappropriate or offensive;
• Materials, photographs or videos that feature another person, or the details of another person, that you have posted without that person’s consent;
• Posts that are advertisements or are commercial in nature (unless we give you permission) or posts that are “junk mail” or SPAM; or
• Posts that pose or create a privacy or security risk to any person.

We reserve the right to delete or modify any post, in our absolute discretion, including where it contains material, which in our opinion, does not comply with these guidelines, or to block any user for failing to comply with these guidelines, or who seeks to damage the community, or displays threatening, bullying or offensive behaviour towards Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network or our audience members.

Continued behaviour of this nature will result in the offending user/s being blocked and may be reported.

To the extent permitted by law, we hold no liability for any loss or damage caused by or in connection with the removal of, or modification of, any post or comment or if you are blocked access or reported to the relevant social media platform due to your behaviour.

You acknowledge that posts made by third parties do not necessarily reflect the opinion of WOM Insights (trading as Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network). When you post any materials (“Content”) you, unless Mouths of Mums®, ReviewbyYou®, YOMM® or WOM Network advises otherwise, license and grant WOM Insights, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use and warrant that you have the full authority to grant these rights.

Can I use the content from Mouths of Mums®, ReviewbyYou®, YOMM® or WOM Network?

Everything located on the Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network websites is the exclusive property of WOM Insights Pty Ltd or used with express permission of the copyright and/or trademark owner. Any copyrighting, transmitting, posting, linking, deep linking, or otherwise modifying these sites without the express written confirmation of WOM Insights Pty Ltd is strictly prohibited. Any violation of this policy may result in a copyright, trademark or other intellectual property right infringement that may subject you to civil and/or criminal penalties.

The Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network websites contain copyrighted material, trademarks and other proprietary information, including, but not limited to, text, software, photos, video, graphics, music, and sounds. The websites are protected by copyright under the Australian and international copyright laws. WOM Insights Pty Ltd owns copyright in the selection, coordination, arrangement and enhancement of such content, as well as in the content created by Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network. You may not modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part.

Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network, their respective logos, icons and marks, products and services are registered trademarks of WOM Insights Pty Ltd. You may download, print, or save copyrighted material for your personal use only. If you would like to use any information from Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network that is not for your personal use, please feel free to contact us and we will endeavour to assist you.

Does WOM Insights Pty Ltd monitor our messages?

WOM Insights shall have the right, but not the obligation, to monitor the content of the Sites and our social media pages at all times, including any comments that may be included as part of the Sites and social media pages. WOM Insights shall have the right to remove any material that may be deemed offensive, sexually explicit, or inappropriate.

What are the general WOM Insights competition terms and conditions?

All competitions promoted via Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network are open to all Australian residents only, unless otherwise stated. The minimum age of entrants is 18 years old unless otherwise stated.

Competition entries must be:

1. the original independent creation of the entrant
2. owned by the entrant, and
3. free of any claims, including copyright or trademark claims, by other parties.

Competition entries must not have:

1. been published previously,
2. won prizes or awards in other competitions, or
3. infringe any third party rights.

Multiple entries will be accepted but entrants and each entry must contain a unique response to the Competition Question.

At the time and date specified in the competition, the judges will choose the winner/s as the entrants with the most creative and original response to the question asked. The best entrant will be chosen to win that particular prize.

Chance plays no part in determining the winners, unless otherwise stated in the competition. Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network reserve the right to verify the validity of entries and disqualify any entrant submitting an entry which, in our opinion, includes objectionable content, including but not limited to profanity, nudity, potentially insulting, scandalous, inflammatory or defamatory images or language.

The prizes must be taken as stated, and no compensation will be payable if a winner is unable or unwilling to use the prize or any element of the prize as stated. A prize cannot be transferred to any other person. There can be no changes made to travel arrangements once tickets are issued. Any unused portion of the prize is forfeited. The prizes are strictly as stated above, are not transferable or exchangeable and cannot be taken as cash.

Entry details remain the property of the WOM Insights. The name, photograph and entry of the winner may be used for promotional purposes by Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network in any media worldwide for an unlimited period of time without remuneration or compensation, unless the winner otherwise notifies WOM Insights in writing at the time of accepting the prize.

Acceptance of these Terms & Conditions is a condition of entry in the competition. The winner will be notified either by telephone or by email, using the details provided in their entry, and the name and suburb of the winner will be published on the competition page, unless otherwise stated. If the winner cannot be contacted using the details provided, or does not respond within the timeframe requested, the winner will forfeit the prize and a new winner will be selected.

If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, we reserve the right at our sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.

WOM Insights assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. WOM Insights is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by us on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant’s or any other person’s computer related to or resulting from participation or downloading any materials in this competition.

We LOVE being able to reward our wonderful audience members for genuine interactions on our site and will do our best, if you’re a lucky prize recipient, to deliver your prize to you. Please note that we will attempt delivery a maximum of two times, from there if you haven’t been able to be home to accept delivery then your prize will be left at your local post office for you to arrange collection at your own expense. We do our very best to ensure we can deliver so to help us please ensure your profile is up to date and that you’ve included a phone number in case we need to contact you. If you have unsubscribed or haven’t provided a phone number it makes it difficult to contact you in regards to prize delivery and your prize may not be able to be delivered – we are not liable for any missing prizes.

What happens if someone tries to violate information from Mouths of Mums®, ReviewbyYou®, YOMM® and/or WOM Network?

Any attempt to deliberately damage the Mouths of Mums®, ReviewbyYou®, YOMM® and/or WOM Network websites or the information in any of our communications (such as our social networking sites or other promotions related), may be a violation of criminal and civil laws. WOM Insights reserves the right to seek damages to the fullest extent permitted by the law.

These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition. WOM Insights reserves the right to amend these terms of participation at any time. All updates to these Terms will be posted on the WOM Insights websites (Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network) with the revised dates.

Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network review and competitions policy

In consideration of being allowed to participate in any way in Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network programs, product reviews, related events and activities, and use of equipment, I acknowledge, appreciate, and agree that:

1. There may be a risk of injury involved in using any of the products provided to be by Mouths of Mums®, ReviewbyYou®, YOMM® and/or WOM Network. The risk of injury from the activities involved in this program may be significant, including the potential for injury, disability and death.
2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, and assume full responsibility for my participation.
3. I willingly agree to comply with terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of WOM Insights.
4. I HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS WOM Insights Pty Ltd (trading as Mouths of Mums®, ReviewbyYou®, YOMM® and WOM Network), its officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH I may suffer, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

I will notify Mouths of Mums®, ReviewbyYou®, YOMM® and/or WOM Network ownership or employees if I suffer from any medical or health condition that may cause injury to myself, others, or may require emergency care during my participation.
